| Apply Leniency
The Competition Act provides for a Leniency Regime provision (Section 44 of the Act) that allows a reduction of up to a maximum 100% of any penalties imposed to those involved in anti-competitive agreements or cartel agreements, in exchange of full disclosure and cooperation.
The key features of the leniency regime are as follows:
- Leniency is only available to undertakings that have admitted their involvement in any infringement of any section 11 prohibition;
- Leniency may be available if the undertaking has provided information or other form of co-operation to the Commission which significantly assisted, or is likely to significantly assist, in the identification or investigation of any finding of an infringement of any prohibition by any other undertakings.
- Leniency may permit different percentages of reductions to be available to an undertaking, dependent on whether the undertaking was the first person to bring the suspected infringement to the attention of the Commission, the stage in the investigation the involvement was admitted or information was provided, and any other circumstances which the Commission considers appropriate to have regard to.
The Guidelines on Leniency set out detailed processes and procedures adopted by the CCBD in relation to the Leniency Regime (Section 44 of the Competition Act).
